Last updated: March 2026 TERMS OF SERVICE Please read these Terms of Service ("Terms") carefully before using the Szelfie mobile application ("App") operated by TETRAI YAPAY ZEKA TEKNOLOJI BILISIM VE ILETISIM TICARET LIMITED SIRKETI ("Company", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. 1. Eligibility You must be at least 18 years old to use Szelfie. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, you are not permitted to use the App under any circumstances. 2. Description of Service Szelfie is an AI-powered photo generation application. The App allows users to: - Upload reference selfies to create a personal profile - Select from 50+ creative photo packs (World Tour, Luxury Life, Summer Vibes, etc.) - Generate AI-powered photos using their face in various scenes and styles - Use DUO mode to generate photos with two people - Generate images in Instagram Post or Story aspect ratios - Save and share generated images The App uses Google Gemini AI to generate images based on your uploaded reference photos. 3. Account Registration To use Szelfie, you must create an account using one of the following methods: - Google Sign-In - Apple Sign-In You are responsible for maintaining the security of your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account. You may only create one account per person. Creating multiple accounts to abuse free credits or promotions is prohibited. 4. Credits and In-App Purchases Szelfie uses a credit-based system for generating photos. Purchase: Credits are purchased through Apple App Store or Google Play Store as consumable in-app purchases. All payment processing is handled by Apple or Google, not by Szelfie directly. Pricing: Credit pack prices are displayed in the App before purchase. Prices may vary by region and currency. Non-transferable: Credits are tied to your account and cannot be transferred, gifted, or sold to other users. No expiration: Purchased credits do not expire as long as your account remains active. No cash value: Credits have no monetary value and cannot be redeemed for cash. Final sale: All credit purchases are final. Refunds are handled in accordance with our Refund Policy and the policies of Apple App Store or Google Play Store. 5. User Content and Photos Ownership: You retain full ownership of all photos you upload to Szelfie. License grant: By uploading reference photos, you grant Szelfie a limited, non-exclusive, revocable license to process and use those images solely for the purpose of generating AI photos for your account. This license terminates when you delete your photos or your account. Your responsibility: You are solely responsible for the photos you upload. You represent and warrant that: - You have the right to upload and use the photos - The photos depict you or a person who has given you explicit consent - The photos do not contain illegal, obscene, or harmful content - The photos do not depict minors (persons under 18 years of age) No training: We do not use your uploaded photos or generated images to train, fine-tune, or improve AI models. Your photos are used exclusively for generating images for your account. 6. Generated Content License: AI-generated images created through Szelfie are licensed to you for personal, non-commercial use. You may share generated images on social media platforms and messaging apps. No guarantees: AI-generated results may vary in quality and accuracy. We do not guarantee that generated images will meet your expectations or achieve a specific result. The AI may occasionally produce artifacts, distortions, or unexpected outputs. Prohibited use of generated content: You may not use generated images to: - Impersonate another person or create false identities - Create misleading, defamatory, or fraudulent content - Produce content that is illegal under applicable law - Generate sexually explicit, violent, or hateful content - Create political advertisements or propaganda using someone's likeness without consent - Engage in harassment, bullying, or intimidation 7. Prohibited Conduct You agree not to: - Upload photos of minors or any person under 18 years of age - Upload photos of any person without their explicit consent - Use the App to create deepfakes or misleading content intended to deceive others - Attempt to reverse-engineer, decompile, or disassemble the App or its AI models - Circumvent, disable, or interfere with security features of the App - Use automated scripts, bots, or other tools to interact with the App - Resell, redistribute, or sublicense generated content for commercial purposes without written permission - Use the App in any way that violates applicable local, state, national, or international law - Interfere with or disrupt the App's infrastructure or other users' experience - Attempt to gain unauthorized access to other users' accounts or data - Upload content that contains malware, viruses, or harmful code 8. Intellectual Property The App, including its design, user interface, branding, logos, and underlying AI technology, is the exclusive property of TETRAI YAPAY ZEKA TEKNOLOJI BILISIM VE ILETISIM TICARET LIMITED SIRKETI and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent. "Szelfie" and the Szelfie logo are registered trademarks of TETRAI YAPAY ZEKA TEKNOLOJI BILISIM VE ILETISIM TICARET LIMITED SIRKETI. 9. Privacy Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy. 10. Third-Party Services The App integrates with the following third-party services: - Google Sign-In and Apple Sign-In for authentication - Google Gemini AI for image generation - Secure cloud storage for image hosting - Apple App Store and Google Play Store for payment processing These services have their own terms of service and privacy policies. We are not responsible for the practices of third-party services. 11. Disclaimers THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: - The App will be uninterrupted, error-free, or secure - Generated images will be accurate, complete, or satisfactory - Defects will be corrected in a timely manner - The App will be compatible with all devices or operating systems 12. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TETRAI TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. Our total aggregate liability for all claims related to the App shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim. 13. Indemnification You agree to indemnify, defend, and hold harmless TETRAI YAPAY ZEKA TEKNOLOJI BILISIM VE ILETISIM TICARET LIMITED SIRKETI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Content you upload or generate through the App 14. Account Suspension and Termination We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: - Violation of these Terms - Uploading prohibited content - Fraudulent activity or abuse of the credit system - Extended period of inactivity (12 months or more) Upon termination: - Your license to use the App is immediately revoked - Your access to generated images may be permanently removed - Unused credits will be forfeited - We may delete your account data, including uploaded and generated images You may delete your account at any time through the App's Profile settings. 15. Dispute Resolution Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration. 16. Modifications to Terms We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically. 17. Severability If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. 18. Entire Agreement These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and TETRAI YAPAY ZEKA TEKNOLOJI BILISIM VE ILETISIM TICARET LIMITED SIRKETI regarding the use of the App. 19. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. 20.
